THE
REGIONAL ENVIRONMENTAL AUDITOR CASE
.Allegations
(Part One)
Allegations
(Part Two)
In
summary the allegations stated that the
company was engaged in the irrational
exploitation of the forest, working without
approvals, harvesting under approved
diameters, and transporting wood without
markings and were demanding an inspection in
the field.
(“de explotacion
iracional de bosque, trabajar sin un permiso
de aprovechamiento, realizar corta de árboles
con DAP no autorizados, transporte de madera
sin marcar”).
However, INAFOR has never opened an
administrative case against Limi-Nawâh and an
inspection for this purpose has never taken
place to eliminate the charges against
Limi-Nawâh.
In
June 05, 2005 the Alcaldia responded to the
Procurador and others stating that
Limi-Nawâh was in fact operating with all
appropriate permissions and that the
operations of the company were totally legal
within the Municipality. (Letter
from the Municipality)
and that the claims
made by Dessler Watson and Olivia Hills White
were false. In November of 2005, Olivia Hills
White signed a retraction of her denucia
claiming that she had been negatively
influenced by lies of Mr. Dud Erminger. (Carta
de Retracción)
The case has never been resolved and the
consequences have been severe for Limi-Nawâh.
In particular, the Regional Government has
refused top process licence requests for three
portable sawmills that Limi-Nawâh owns and the
Institute of Rural Development uses the case
as a reason that they cannot honbour the
convenio for capital equipment owing to
Limi-Nawah. (Carta
del IDR).
These actions have prevented Limi-Nawâh from
conducting efficient business in Nicaragua.
In June of 2006 an inter-institutional
commission conducted and assessment of
Limi-Nawâh’s operations and although there
were some minor administrative concerns, none
of these claims made by Mr. Watson and
Erminger were substantiated. |
