PROLIFERATION IN DEMANDS FOR PROTECTION

Ninety-two residents of the Territory Prinzu Awala submitted Requests for Shelter from Law 585 to the Supreme Court of Justice on grounds that the Law, among other things,  criminalizes and sanctions their their customs and traditions which are guaranteed under the Political Constitution of Nicaragua and threatens to kill their company, Limi-Nawâh.

Law 585 of Industrial Forestry Sanctions (VEDA Forestal) in June of 2006 and the Presidential Economic Emergency Decree No. 32 in May 2006  – these threaten to attempt to reform industrial forestry operations through the application of unconstitutional and punitive  legislation against indigenous people and their company Limi-Nawâh.

THE INSTITUTE OF RURAL DEVELOPMENT (IDR) CASE

Read the following chronology and be your own judge if IDR was helping or blocking  Limi-Nawâh's access to international funds:

 

Detrimental Reliance and/or gross incompetence, economic and/or cultural discrimination,  lack of political will, lack of professional conduct on the part of IDR have cost Limi-Nawâh hundreds of thousands of dollars ($US) of losses, foregone economic opportunities, loss in credibility for the corporation  and has threatened the very existence of the company.

ONE VISIBLE EXAMPLE OF THE CONSEQUENCES OF THE IDR  DISFUNCTIONALITY

The failure of IDR to honour an already signed agreement to purchase capital equipment severely limited the capacity of Limi-Nawâh to execute an approved business plan  and exposed the company to a damaging detrimental reliance on the Government of Nicaragua.  It is worth mentioning that the Government of Canada contributed more than $250,000 as counterpart to IDR to cover non-capital costs.
